01 About these terms
These terms apply to surfbase.app, the Surfbase web app, and the Surfbase iPhone app. By creating an account or using any of them, you accept these terms. If you don’t accept them, please don’t use Surfbase.
If you use Surfbase for a business, you accept these terms for that business, and you confirm you’re allowed to.
- “We” and “us”
- Surfbase Platforms (ABN 72 119 661 713), which operates Surfbase.
- “You”
- The person or business using Surfbase.
- “Workspace”
- The shared space a board business works in: its designs, customers, orders and settings.
02 Accounts and workspaces
You need an account to use Surfbase. Give us accurate details and keep them up to date. Keep your password and sign-in methods safe, and tell us straight away if you think someone else has got into your account.
Each account belongs to one person. A workspace is where a business keeps its work, and it can have several people in it, each with a role:
- Owner
- Holds the workspace. Chooses the plan, pays for it, and can close the workspace. Each workspace has one owner.
- Admin
- Runs the workspace day to day, including inviting and removing people.
- Member
- Works in the workspace with the access an owner or admin gives them.
The owner is responsible for the people they invite and for what happens in the workspace. Remove people who no longer need access.
03 Plans and billing
Surfbase has four plans: Free, Basic, Pro and Business. Plans are priced per workspace, not per person. What each plan includes, and what it costs, is on our pricing page.
- Payment
- Paid plans are subscriptions, charged through Stripe. Your card details go to Stripe, not to us.
- Billing period
- You pay in advance, monthly or yearly where we offer a yearly price.
- Renewal
- A subscription renews automatically at the end of each period until you cancel it.
- Cancelling
- You can cancel at any time in Settings. Your plan stays active until the end of the period you’ve paid for, then the workspace moves to Free.
- Refunds
- We don’t refund part-used periods, except where the law requires it.
- Plan limits
- Each plan has limits, such as how many designs or people it includes. If you go over a limit, you may need to upgrade before you can add more.
- Price changes
- We’ll give you at least 30 days’ notice by email before a price change applies to you. The new price starts from your next renewal after that notice. If you don’t want to pay it, you can cancel before then.
- Tax
- Prices are in Australian dollars. GST or any other tax that applies is shown before you pay and on your tax invoice.
If a payment fails, we’ll tell you and try again. If it still can’t be collected, we may move the workspace to Free until it’s paid.
04 Your customers’ information
A workspace holds information about the people your shop deals with: riders, buyers, their orders and their contact details. That information is yours.
Your shop
You are the controller
You decide what to collect about your customers and what happens to it.
Surfbase
We are your processor
We handle it only to run Surfbase for you, and only on your instructions.
Our data processing terms set out how we handle that information, and they form part of these terms. You’re responsible for having the right to give it to us, and for telling your customers how you use it.
05 Your designs and content
Your designs are yours. You keep every right you have in the designs, files, images and other content you put into Surfbase. We don’t claim ownership of any of it.
To run Surfbase, we need your permission to store your content, copy it, render it in 2D and 3D, and show it to the people you choose. You give us that permission, worldwide and free of charge, only for running and improving Surfbase for you. It ends when you delete the content or close your account, apart from backups that age out on their own cycle.
When you share a design through a share link or a shop page, anyone with the link can see it. You can turn a link off at any time.
Surfbase itself, including the software, the name, the logo and the site, belongs to us. If you send us ideas or feedback, we may use them without owing you anything.
06 Using Surfbase fairly
Don’t use Surfbase to:
- Break the law
- Store or share anything unlawful, or contact your customers in a way the law doesn’t allow.
- Take others’ work
- Upload designs, graphics or files you don’t have the right to use.
- Harm the service
- Try to break, overload, probe or get unauthorised access to Surfbase or anything behind it.
- Get around limits
- Scrape it, resell it, or work around plan limits or security controls.
If you find a security problem, tell us at hello@surfbase.app and give us a fair chance to fix it before you tell anyone else.
07 Third-party services
Some parts of Surfbase rely on other companies. When you use them, their own terms apply as well as ours:
- Stripe Payments
- Takes payment for your plan, and from your customers when they pay you through Surfbase.
- Shopify Store
- Connects a Shopify store you choose to link.
- Xero Accounting
- Connects your Xero organisation, if you choose to link it.
- Apple, Google, Microsoft Sign-in
- Let you sign in with an account you already have, instead of a password.
We don’t control these services and we’re not responsible for them. If one of them changes or stops, a connection to it may stop working. You can disconnect any of them at any time.
08 The iPhone beta
The Surfbase iPhone app is in beta. We invite people to test it through Apple’s TestFlight, and Apple’s TestFlight terms apply too.
The app shows your workspace; it doesn’t replace the web app. Your workspace and its data stay on our servers either way.
09 Availability and changes
We work hard to keep Surfbase running, but we can’t promise it will always be available or free of errors. We sometimes need to take it offline for maintenance, and we’ll try to do that at quiet times.
Surfbase changes as we improve it. We may add, change or remove features. If a change takes away something important from a paid plan, we’ll tell you before it happens.
10 Suspension and closing an account
You can leave at any time. Cancel your plan, then close your workspace or your account in Settings.
We may suspend or close an account if you seriously or repeatedly break these terms, if a payment stays unpaid, or if we need to protect Surfbase, other users or the law. Where it’s reasonable, we’ll warn you first and give you time to fix the problem.
11 Disclaimers and liability
Subject to that, we provide Surfbase as it is and as it’s available, and we don’t make any promise about it that these terms don’t state. Check your designs, measurements and orders before you build from them or charge for them.
As far as the law allows:
- Indirect loss
- We’re not liable for indirect or consequential loss, or for lost profits, revenue, data or goodwill.
- Our limit
- Where a guarantee can’t be excluded but can be limited, our liability is limited to supplying the service again, or paying the cost of having it supplied again.
- Overall cap
- Otherwise, our total liability is limited to what you paid us in the 12 months before the claim.
12 Changes to these terms
We may update these terms. The current version is always the one on this page, with the date at the top. If a change materially affects you, we’ll email the workspace owner at least 30 days before it takes effect. If you keep using Surfbase after that, the new terms apply.
13 Governing law
These terms are governed by the laws of Queensland, Australia. You and we submit to the courts of that place.
